1. Agreement to Terms & Eligibility
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Host”, or “Guest”) and GiftThem (operated by Hipartner Technologies, “Company”, “we”, “us”). By accessing our website, creating an event, generating digital invitations, booking service providers, or transferring gifts, you agree to be bound by these Terms.
You represent that you are at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872.
2. Platform Services & Scope
GiftThem provides an all-in-one digital celebration ecosystem comprising:
- Digital stationery, WhatsApp story invitations, and cinematic musical video invites.
- Interactive mini-websites featuring venue maps, itineraries, and live RSVP collection.
- Direct UPI QR code settlement technology for commission-free shagun transfers.
- Private event PhotoDump albums with biometric face-recognition matching.
- A curated directory of verified event planners, photographers, caterers, and decorators.
3. Host Obligations & Content Warranties
When creating an event or publishing invitations, you agree and warrant that:
- All event information, dates, schedules, and venue directions provided are accurate and truthful.
- You own or possess all requisite rights and permissions for photos, audio tracks, and text uploaded.
- You will not upload defamatory, obscene, infringing, or unlawful content.
- You are responsible for maintaining the confidentiality of your account credentials.
4. Direct UPI Gifting & Bank Settlements
Facilitator Role:GiftThem acts solely as a technical routing interface and software facilitator for UPI gifting. We connect guests directly to the host's verified bank account or UPI VPA via authorized NPCI banking rails.
Zero Platform Commission: GiftThem charges 0% commission on cash shagun received. The entire transferred amount belongs to the host.
Accuracy of Banking Details: The host is solely responsible for ensuring the accuracy of their registered UPI ID and bank details. GiftThem shall not be held liable for funds routed to incorrect accounts due to host data entry errors.
5. Service Provider Marketplace & Escrow
Service providers listed on GiftThem operate as independent contractors. While GiftThem conducts identity and portfolio verification:
- Advance booking deposits are held in secure escrow and released upon confirmed milestone delivery.
- In the event of vendor no-show or cancellation, the deposit is 100% refunded in accordance with our Money Back Guarantee.
- GiftThem is not liable for secondary damages or indirect losses arising from vendor performance on the event day.
6. Intellectual Property Rights
GiftThem retains all proprietary rights in our design templates, animation engines, interactive web code, and branding. You are granted a limited, personal license to use generated invitations solely for your private celebration.
7. Limitation of Liability & Disclaimers
The platform is provided “as is”. While we strive for 99.9% uptime, GiftThem shall not be held liable for delays caused by third-party telecom outages, NPCI banking downtimes, or disruptions beyond our reasonable control.
To the maximum extent permitted by Indian law, our aggregate liability shall be limited to the total fees paid by you to GiftThem in the preceding 6 months.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent civil courts located in Bengaluru, Karnataka or Chittoor District, Andhra Pradesh, India.
